Arbitration / Mediation

Massachusetts Alternative Dispute Resolution Lawyer

Alternative dispute resolution (ADR) is a growing alternative to litigation. It is often a faster, less expensive, and more controllable process. ADR, however, is not suitable for every client or every case.

The Law Offices of B. J. Krintzman will advise you about whether resolving your dispute through arbitration or mediation would serve your best interests. If ADR is an appropriate forum for resolving your claim, our lead attorney, B. J. Krintzman, can represent you in a business, family law, divorce, or real estate mediation or arbitration.

B. J. Krintzman is a seasoned arbitrator and mediator, who has arbitrated hundreds of commercial, business, employment, contract, executive compensation, landlord-tenant, and condominium association disputes. She is highly regarded among the Massachusetts legal community for her top-notch work in the field of ADR. In fact, Ms. Krintzman speaks widely on this topic, delivers frequent lectures, and conducts frequent ADR seminars for her legal peers. She has also written widely on the topic of alternative dispute resolution and you can find several of her articles in the Articles section of this website.

Located in Newton, Massachusetts, our firm provides clients with the experience of a large Boston firm, as well as the comfort and affordability of an easily accessible suburban office. Contact us to speak with a highly skilled lawyer about the benefits of arbitration and mediation.

Arbitration

Many claims which do not go to court are settled through arbitration, which is a process whereby both sides are allowed to present evidence and make arguments before a neutral arbitrator who will make the ultimate decision. Arbitration may be court ordered, contractually obligated, or independently chosen. At our firm, lead attorney B. J. Krintzman, serves as an arbitrator for disputes brought before the:

  • American Arbitration Association (AAA)
  • New York Stock Exchange (NYSE)
  • National Association of Securities Dealers (NASD)
  • United States District Court for the District of Massachusetts
  • Massachusetts Bar Association (MBA)
  • Better Business Bureau (BBB)

Mediation

Mediation is preferable in some cases, for instance where the parties will have a continuing relationship after the dispute is settled. Also called non-binding facilitated negotiation, mediation is a process whereby parties reach agreement with the help of a neutral third party mediator. Whether mediation is court ordered, contractually obligated, or independently chosen, B. J. Krintzman, can serve as a mediator in:

  • Business disputes - discrimination, harassment, executive compensation, accounting, and contract disputes
  • Family law and divorce disputes - disputes concerning a parenting plan, child custody, visitation, child support, spousal maintenance
  • Real estate disputes - title, boundary, landlord-tenant disputes

B. J. Krintzman has mediated dozens of cases, has a solid track record of success, and has established a reputation as a premier mediator.
